This category of immigration is for individuals who may not otherwise be qualified to become permanent residents of Canada, but who might be allowed to apply on humanitarian and compassionate grounds. People with extraordinary circumstances are protected on humanitarian and compassionate grounds. These applications are evaluated on an individual basis. The following are some of the factors that are taken into account:
How long the individual has lived in Canada
Family relations to Canada in general
Any children involved's best interests, and
What would happen if you do not obtain permanent residency in Canada
If you meet the following criteria, you can apply for permanent residence on humanitarian and compassionate grounds (H&C) from within Canada.
Are currently residing in Canada as a foreign national;
Believe that humanitarian and compassionate reasons warrant granting the exemption(s) you require; and
Plan to live somewhere other than Quebec.
In any of these categories, you are ineligible to apply for permanent residency from within Canada:
Spouse or Common-Law Partner
Live-in Caregiver
Caregivers: caring for children or people with high medical needs
Protected Person and Convention Refugees
Temporary Resident Permit Holder
This class is for persons who do not meet the normal requirements of the Immigration Act and Regulations, but whose circumstances necessitate humane and compassionate consideration.
