Family class immigration includes the spousal sponsorship scheme. A Canadian citizen or permanent resident can sponsor a spouse or common-law partner for permanent residency in Canada under this scheme. The Canadian government allows citizens and permanent residents to sponsor family members, but it insists that the sponsors provide care and assistance to the incoming immigrants.
Both the sponsor and the sponsored must be able to prove their relationship and fall into one of three groups in order to obtain a visa under this immigration programme.
This indicates that the Sponsor and the sponsored individual are legally married and have documentation to back up their assertion.
Both parties in a common-law partnership should live together for at least a year, except brief absences for company or family reasons
A conjugal partner is a person from another country who has been in a conjugal relationship with a sponsor for at least one year but is unable to live with the sponsor as a couple.
This scheme allows a Canadian citizen or permanent resident to support his or her spouse/common-law partner for permanent resident status regardless of where the spouse is actually living.
1. The Canadian or Permanent Resident submits an application to sponsor his or her spouse or common-law partner.
2. Permanent residency is applied for by the spouse or common-law partner.
When the sponsored individual lives outside of Canada, the outland sponsorship route is usually chosen. A spouse or common-law partner living in Canada, on the other hand, can apply through the outland programme. This choice can allow the sponsored person to move in and out of Canada during the application process, but the decision to allow the sponsored person to re-enter Canada is always at the discretion of the Canadian immigration authority.
When the sponsored individual lives inside Canada, inland sponsorship is the best option.
Although inland applications take longer to process than outland applications, those who are funded by the inland programme may be qualified for an open work permit while their application is being processed. If an interview is required, IRCC will inform you in writing of the date, time, and place of the interview, as well as all required documentation.
A stream for family members of Canadian citizens and permanent residents is available through the Family Class sponsorship scheme.
The sponsor in Canada must meet the following conditions to be eligible for Family Class sponsorship:
Sponsors must show that they meet the minimum income standards by submitting notices of assessment from the Canadian Revenue Agency (CRA) in support of their sponsorship, as well as demonstrating that they have reached the required income standard for three years in a row.
